In the ‘2016 Information and Security breaches Survey Technical Report’ stated that the percentage of companies suffering a breach has increased since the 2014 report with 90% of large organisations and 74% of small business having suffered a security breach. In addition the overall cost of breaches has also risen, the average for the worst security breach of the year for large organisations is between £1.46 mil and £3.14 mil and between £75,000 and £311,000 for small businesses. According to the ICO Guide to Encryption; "In recent years there have been numerous incidents where personal data has been stolen, lost or subject to unauthorised access...The Information Commissioner has formed the view that in future, where such losses occur and where encryption software has not been used to protect the data, regulatory action may be pursued."


Previous examples of these penalties include:


Norfolk County Council - left files that included sensitive information about children in a cabinet sent to a second hand shop.


Data breach by Barrister - who failed to keep clients’ sensitive personal information secure has been fined £1,000 by the Information Commissioner’s Office.


Royal & Sun Alliance Insurance PLC - have been fined £150,000 following the loss of the personal information of nearly 60,000 customers.
